Can My Employer Require Me to Stay Home?

Yes—according to the U.S Equal Employment Opportunity Commission (EEOC), your employer is allowed to require workers to stay home if they exhibit COVID-19 symptoms. Since the Centers for Disease Control and Prevention (CDC) advise that those who show exhibit these symptoms should stay home and limit social contact, the ADA does not have any stipulations that interfere with this medical advice.

What Else Is My Employer Allowed to Do?

The EEOC has confirmed that employers are also able to perform the following actions without violating the provision outline in the Americans with Disabilities Act:

  • Take an employee’s temperature.
  • Ask if an employee is experiencing COVID-19 symptoms—as long as the information remains confidential.
  • Administer a COVID-19 test before allowing employees to enter the workplace if it is job-related and consistent with business necessity.
  • Require a doctor’s note for employees, confirming that they do not have the virus and are fit to return.
