The Steps
The first call

Federal law has several separate systems. MSPB, EEO, OPM and OSC.
Picking the wrong one can close off options for good.
Deadlines
Every date that applies gets written down.
- MSPB appeals: 30 calendar days from the effective date of the removal, or from the day you receive the agency's decision, whichever is later
- VA removals: 10 business days
- OPM disability retirement: within one year of separation from federal service
- EEO: 45 days to contact an EEO counselor
These are general timelines. Your own deadline depends on your situation, and some cases have exceptions. Checking that is one of the first things we do.
Building the record
Cases are won on what is documented.
A doctor's note confirming a condition is not enough. It must show how that condition blocks the specific duties of the job. We work with your doctors to get that right.
Handling the agency
Agencies do not always move quickly, and sometimes they withhold documents.
That back and forth becomes our job.
The hearing
If a case goes to the MSPB there is discovery, depositions, sometimes mediation, then a hearing.
Full preparation comes first, including cross examination.
After a denial
A denial is not the end of the road. OPM denials go to reconsideration, then the MSPB, SSDI denials go to reconsideration, a judge, the Appeals Council, then federal court.

How a Case Gets Approached
The forum comes first
Federal employment law is several systems side by side, each with its own rules and its own decision-makers.
The same facts might belong at the MSPB, the EEO process, the Office of Special Counsel, or OPM. Sometimes there is a choice between two, and that choice affects where the case can be heard later. Sorting out the right path is step one.
If you are not sure which system your case belongs in, that is normal. Most people are not.

An MSPB judge weighs different things than an EEO investigator or an OPM examiner.
So filings go to the right office, with the right supporting documents, framed around what that specific decision maker will review.
