Living with a serious health condition can affect every part of your life, from your ability to work to your ability to keep up with medical care. What is SSD Eligibility?
To qualify for Social Security Disability Insurance (SSDI), you must meet both medical and work-related requirements. Social Security looks at whether your condition is severe, long-lasting, and limiting enough to prevent you from performing work that can provide a gainful income. You must also have enough work credits earned through previous employment that paid into Social Security.
You may be eligible for SSDI if:
- Your medical condition is expected to last at least one year or be terminal or permanent.
- You cannot return to your past relevant work.
- You cannot reasonably adjust to new forms of work due to your limitations.
- You have earned enough work credits.
- Your condition meets or equals a Listed impairment.
- Your functional restrictions significantly reduce your ability to maintain full-time work.
How We Can Help With Your SSD Claim
For many applicants, filing an SSD claim is one of the most important steps they will take toward long-term stability after experiencing a disabling medical condition. We can help you prepare and present your case in a way that makes everything clear for you and any SSA assessor who views your claim.
Our legal support can include:
- Reviewing and organizing medical evidence, so your records clearly reflect your diagnosis, symptoms, and functional limitations.
- Identifying missing or inconsistent documentation that could lead to avoidable denials.
- Gathering additional statements or records from treating providers to clarify complex or poorly understood medical conditions.
- Explaining how your symptoms affect your daily functioning so your claim reflects the full impact of your condition.
- Correcting work credit errors by reviewing your earnings history, gathering payroll or tax records, and requesting corrections from Social Security.
- Evaluating residual functional capacity (RFC) assessments to identify unsupported assumptions or inaccuracies.
- Challenging flawed RFC findings by comparing them to medical evidence, documented symptoms, and your real-world functional limits.
- Preparing and filing SSD appeals, including reconsideration requests, hearings before administrative law judges, Appeals Council reviews, and federal court actions when appropriate.
- Explaining justified noncompliance with medical treatment, such as cost constraints, side effects, or other barriers.
- Providing clear, consistent communication so you understand every stage of the process and know what information is needed next.
- Managing deadlines and paperwork.
SSDI Benefits in Colorado
If you qualify for SSDI, you may receive several financial and medical benefits designed to provide long-term support. These benefits are consistent across all states, including Colorado, because the SSDI program is federally administered.
SSDI benefits may include:
- Monthly disability payments based on your past earnings
- Retroactive benefits for qualifying months before you applied
- Additional benefits for certain dependents, such as children or spouses
- Cost-of-living adjustments (COLA) to help keep pace with inflation
- Medicare coverage, available after a waiting period for most beneficiaries
