Eligibility Criteria for OPM Disability Retirement

You may be entitled to Office of Personnel Management (OPM) disability retirement benefits if you are injured, ill, or have a disability that prevents you from performing at least one essential part of your job as a federal employee. You may be eligible even if you are no longer a federal employee and/or if you were terminated from your position.

Eligibility for OPM disability retirement benefits does not require that your disability result from a work-related injury or medical condition. Unlike Social Security Disability, you can qualify if you are partially disabled.

All federal employees may be eligible for disability benefits under the following personnel systems:

  • Federal Employees Retirement System (FERS) after 18 months of service
  • Civil Service Retirement Service (CSRS) after 5 years of service

The timetable of the application depends on the client’s ability to provide our lawyers with all the necessary information for us to draft documents, as well as the federal agency’s responsiveness. OPM estimates that they require 12 months to review the application and issue a decision.
