OPM Disability Retirement, also known as Federal Disability Retirement, is administered through the Office of Personnel Management (OPM). Federal employees under both the FERS (Federal Employee Retirement System) and CSRS (Civil Service Retirement System) are eligible to apply for disability retirement through OPM.

What Is OPM Disability?

OPM Disability is a benefit that will pay you a percentage of your income through age 62 or until your disability resolves, whichever is sooner. Whether your impairment is caused by injury or disease, you may be entitled to this benefit.

If the claim is approved, you are eligible for 60% of pre-disability income for the first year and 40% every year thereafter while disabled.

Eligibility is based on several factors, including:

  • The employing agency cannot accommodate your disability in your current position
  • There is no other available position at the same pay grade for which you qualify

Timing Is Important

You have one year from the date of disability to submit the required forms to OPM. If you are currently employed by an agency or it’s been one month or less since you stopped work, application is made through that agency. If it’s been longer since you have worked, application is made directly to OPM.

Disability Denial

If you have already applied for disability retirement but have been denied, we can strategize a response during an appeals process. Timing is again crucial. You have only 30 days to request OPM to reconsider your application and provide additional documentation and evidence to bolster your claim. Further appeals can go before the Merit Systems Protection Board and even up to federal circuit court. Ongoing Support

Once you have been approved for OPM Disability Retirement, the process isn’t over. OPM may also require periodic medical updates while you are receiving benefits. Benefits can be suspended if you don’t comply and establish continuing eligibility for disability retirement.
