A federal judge in the U.S. Court of Federal Claims recently granted final approval of a $160 million settlement for unpaid overtime on behalf of nurse practitioners and physicians’ assistants employed by the U.S. Department of Veterans Affairs.

3,200 class members alleged they were forced to work unpaid overtime hours to update patients’ electronic health records and monitor and respond to patient-related notifications in the VA’s Computerized Patient Record System.

Although the litigation was complex, and the risk of non-recovery substantial, the vigorous legal advocacy and insightful points raised by the plaintiffs’ counsel steered the case towards a successful outcome over the span of nearly nine years.

This is one of the largest settlements ever reached in an overtime case involving federal employees, with each class member averaging a recovery of $50,000.
