Exciting News: The Transportation Security Administration (TSA) has now obtained MSPB Rights!
The Transportation Security Administration (TSA) and AFGE have been arguing for the past 20 years for full appeals rights before the Merit Systems Protection Board (MSPB). This past week American Federation of Government Employees (AFGE)—announced that it has achieved victory.
“As of Sept. 26, TSA officers will now have broad appeal rights under the MSPB,” said the American Federation of Government Employees (AFGE), the union representing Transportation Security Officers (TSOs).
TSA employees now share the same rights as other Title 5 employees, such as the right to appeal and contest adverse actions taken by management (e.g., removals, suspensions over 15 days, demotions, etc.) TSA and the MSPB have officially announced an agreement under which the MSPB will review these disciplinary actions.
Securing MSPB rights is a big deal for TSA employees because they now can challenge their disciplinary actions without having to rely on the union to pursue their case for them. Additionally, instead of using the EEO process, which requires these employees to have the burden of proof to show they were discriminated or retaliated against, these employees can now bring their cases before a neutral Judge with their agency having to prove that that the employee should be disciplined.
