We recently assisted a federal
criminal investigator
with her FERS disability claim. This employee was/is suffering from
post-concussion syndrome
as the result of an automobile accident, which is causing her to experience
significant
cognitive impairment, frequent
migraine headaches, and an
impaired ability to balance
(while standing, walking, etc.). Because these symptoms directly interfere
with her ability to perform both the cerebral and physical functions of
her position safely and effectively, we were able to work closely with
her agency to effectuate her removal from federal service for “medical
inability to perform” – which entitled her to the Bruner Presumption
of Disability. Her claim was submitted to OPM in mid-July, and we’re
elated to say that she just received her approval letter this week –
congratulations!
