The Best Time to Reach Out to a Federal Employee Attorney/Lawyer

Many times, I am approached by federal employees with legal issues with the question of when is the best time to approach a federal employee attorney to request legal representation. EEO Disability Accommodation Cases and Lawyers

If you are a federal employee with a mental or physical disability and you need an accommodation it often makes a great deal of sense to hire a federal employee attorney. If you have an open and obvious disability like you are limping or you use a wheelchair or if you have provided your supervisor with proof of a disability that impacts your major life activity, then you are likely entitled to a reasonable accommodation. Of course, you must be “qualified” to perform the essential functions of your job with or without an accommodation.

Once you show you are disabled and qualified you then must request an accommodation that does not constitute an undue hardship on your federal agency. Examples of accommodations that do not reflect an undue hardship are work at home (as long as the employee comes to the office for important and essential meetings and events), ergonomic accommodations, workplace modifications and assistive devices. Many of these accommodation requests are more than reasonable and if the Agency fails to provide them to you the federal employee you should seek an attorney!

Attorney representation in these types of cases can often result in a positive result if these important characteristics are met. Additionally, if the law is on the employee’s side there is an attorney fee reimbursement entitlement under the law. Therefore, in these types of cases there is often less risk in hiring an attorney and much upside potential for accommodation, damages and attorney’s fees reimbursement.
